1. About BankIQ

BankIQ ("we", "us", "our") is a carp fishing forecast and catch logging service operated by BankIQ ("the Service"), accessible at bankiq.app.

2. Accepting These Terms

By creating an account or using the Service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old to create an account.

3. Your Account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@bankiq.app if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free and Premium Plans

BankIQ offers a free tier with limited features and a Premium subscription with full access. Premium is billed monthly (£4.99/month) or annually (£39.99/year), with prices displayed at the point of purchase.

A 7-day free trial is available on first subscription. You will not be charged until the trial period ends. You may cancel at any time during the trial to avoid being charged.

All prices are inclusive of any applicable taxes. We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Cancellation and Refunds

You may cancel your Premium subscription at any time via the account page. Cancellation takes effect at the end of your current billing period; you retain access to Premium features until then.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel a digital service contract. However, by accessing Premium features during this period, you expressly consent to immediate performance of the contract and acknowledge that your right to cancel is lost once the service has been fully performed. You will be charged pro-rata for the period of access used if you cancel within 14 days after accessing the service.

We do not offer partial-period refunds once a billing period has been used. If you believe you have been charged in error, contact us at support@bankiq.app within 30 days of the charge.

6. The Service

BankIQ provides weather forecasts, fishing condition scores, river level data, and catch logging tools. Forecasts and scores are provided for informational purposes only — they are not guarantees of fishing conditions or catches. Fishing is subject to local regulations, permissions, and licences which remain your sole responsibility to obtain.

River and weather data is sourced from the Environment Agency, Open-Meteo, and other third-party providers. We do not guarantee the accuracy, completeness, or real-time availability of this data.

We aim for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications at any time.

7. Acceptable Use

You agree not to: attempt to reverse engineer, scrape, or extract data from the Service in bulk; create accounts by automated means; use the Service for any unlawful purpose; share your account credentials with others; or interfere with the Service's infrastructure or security.

8. Your Content

Catch logs, session notes, and venue data you submit remain yours. By submitting content, you grant us a licence to store and process it to provide and improve the Service. We aggregate and anonymise catch and condition data to improve scoring models. We do not sell your personal data to third parties. See our Privacy Policy for full details.

9. Intellectual Property

The BankIQ name, logo, scoring algorithm, and all content we create are our intellectual property. You may not copy, reproduce, or distribute them without our written permission. Nothing in these Terms transfers any IP rights to you.

10. Limitation of Liability

To the fullest extent permitted by law, BankIQ is not liable for any indirect, incidental, consequential, or special damages arising from your use of the Service, including but not limited to loss of fishing opportunities, equipment, or income. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
